the US Court of International Trade has officially reopened a legal challenge against former President Donald Trump’s move to revoke tariff exemptions for low-value imported packages, reigniting a long-standing trade policy dispute.
Previously, the US Supreme Court ruled that the Trump administration’s use of the International Emergency Economic Powers Act (IEEPA) to impose large-scale tariffs lacked clear legal authorization and was unlawful. However, the ruling did not address the core contentious issue of whether the president has the authority to terminate tariff exemptions for low-value packages, paving the way for the reopening of this lawsuit.
It is understood that the former US policy on tariff exemptions for low-value packages allowed imports valued at $800 or less to be exempt from tariffs. This policy significantly facilitated cross-border e-commerce trade — in 2024 alone, US Customs and Border Protection processed 1.36 billion such small packages.
